Rafter generates AI-assisted document drafts. All output should be reviewed by a qualified professional before use. Nothing in this service constitutes legal, financial, engineering, or safety advice.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Tall Order Craftsmen LLC ("Company," "we," "us"), a Massachusetts limited liability company, governing your access to and use of Rafter (the "Service"), available at rafter.build and related subdomains.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Description of Service
Rafter is a software-as-a-service (SaaS) tool that uses artificial intelligence to help contractors and tradespeople generate professional documents, including bids, proposals, subcontractor quotes, job hazard analyses, toolbox talks, safety checklists, change orders, requests for information, daily site logs, punch lists, and closeout letters.
The Service uses third-party AI infrastructure (currently Anthropic's Claude) to process your inputs and generate document drafts. Document generation is automated and does not involve human review by the Company.
3. Important Disclaimer: AI-Generated Content
All documents produced by Rafter are AI-generated drafts intended as a starting point only. You are solely responsible for reviewing, editing, verifying, and approving any document before it is used, shared, submitted, or relied upon in any professional or legal context.
The Company makes no representation that any generated document is accurate, complete, appropriate for your jurisdiction, compliant with applicable law, or fit for any particular purpose. The Company is not responsible for any losses, damages, disputes, regulatory violations, or adverse outcomes resulting from your use of generated documents.
4. Safety Document Caution
Job Hazard Analyses (JHAs), Toolbox Talks, Daily Safety Checklists, and similar safety-related documents generated by Rafter must be reviewed and approved by a qualified and competent site supervisor or safety professional before distribution or use. These documents do not constitute site-specific safety plans and must be adapted to actual job conditions. Failure to review AI-generated safety documents before use could result in serious injury or death. You assume all risk associated with the use of safety-related output from this Service.
5. Not Legal, Financial, or Professional Advice
Nothing produced by Rafter is legal advice, financial advice, engineering advice, or any other form of licensed professional advice. The Company is not a law firm, accounting firm, or engineering firm. You should consult qualified professionals before relying on any document for legal, financial, or technical decisions.
6. Eligibility
You must be at least 18 years of age and have the legal authority to enter into binding contracts to use the Service. By using the Service, you represent that you meet these requirements.
7. Account Registration
To access the Service, you must create an account by providing your name, company name, and email address, and by completing payment through our third-party payment processor (Stripe). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information at registration and to keep that information current. The Company reserves the right to suspend or terminate accounts that contain inaccurate or misleading information.
8. Subscription and Payment
8.1 Subscription Plan
The Service is offered on a monthly subscription basis at the price listed on the pricing page at the time of purchase. Subscriptions renew automatically at the end of each billing period unless cancelled.
8.2 Payment Processing
All payments are processed by Stripe, Inc. The Company does not store your payment card information. By subscribing, you authorize the Company to charge your payment method on a recurring monthly basis.
8.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods except where required by applicable law.
8.4 Price Changes
The Company reserves the right to change subscription pricing with 30 days' advance notice via email. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.
9. Acceptable Use
You agree not to use the Service to: generate fraudulent or deceptive documents; violate any applicable federal, state, or local law; infringe upon the intellectual property or proprietary rights of any third party; submit false or misleading information as document inputs; attempt to reverse-engineer, copy, or resell any portion of the Service; or use the Service in any manner that could damage, disable, or impair the Service or its underlying infrastructure.
10. Intellectual Property
10.1 Your Content
You retain ownership of the information and data you input into the Service ("Input Content"). By using the Service, you grant the Company a limited license to process your Input Content solely for the purpose of generating your requested documents.
10.2 Generated Output
Documents generated by the Service ("Output Content") are provided to you for your use. The Company does not claim ownership of Output Content. However, because AI-generated content may be similar across users with similar inputs, the Company makes no warranty of uniqueness or exclusivity of any Output Content.
10.3 Company IP
The Rafter name, logo, website, application, prompts, and underlying technology are owned by Tall Order Craftsmen LLC and may not be copied, reproduced, or used without written permission.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Third-Party Services
The Service integrates with third-party providers including Anthropic (AI generation) and Stripe (payment processing). Your use of these services is subject to their respective terms and privacy policies. The Company is not responsible for the practices of any third-party provider.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TALL ORDER CRAFTSMEN LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY DOCUMENT GENERATED THEREBY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE COMPANY'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
15. Indemnification
You agree to indemnify, defend, and hold harmless Tall Order Craftsmen LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, your violation of these Terms, or your use of any generated document.
16. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in such courts.
17. Changes to These Terms
The Company reserves the right to update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before taking effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised Terms.
18. Termination
The Company may suspend or terminate your access to the Service at any time, with or without cause, with notice where reasonably practicable. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including disclaimers, limitations of liability, and governing law.
19. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company with respect to the Service and supersede all prior agreements, representations, and understandings.
